MyOggy.Com Terms of Use:
Guardian Angel Enterprises LLC (also referred to as ‘we’ ‘our’ or ‘us’ for purposes of this Terms of Use Agreement) operates MyOggy.com, and also has the DBA MyOggy.com and MyOggy. This Terms of Use Agreement (also referred to as Agreement) govern all services, applications, features, content and all that is offered and provided at the MyOggy.com website and all myoggy.com URLs including but not limited to the instant messaging, chat rooms applications, video and music and photo uploads and sharing, blogging, or any other feature, content or service at the MyOggy.com website and/ or provided by MyOggy.com. The Terms of Use applies to all Users of the MyOggy.com website, services, applications, content, features, contests, or any other aspect provided or posted by MyOggy.com. The term User refers to a visitor (unregistered vistor) to the website, or a Member (one who has registered at MyOggy.com).
By using or visiting the MyOggy.com website in any way, you agree to be legally bound by this Terms of Use Agreement and any and all applicable laws, whether you are a visitor or a registered member of MyOggy.com, and whether your use or visit of or at MyOggy.com is intentional or unintentional. If you do not agree with any aspect of this Agreement, or to be bound legally by it, or to follow all applicable laws, then you must leave the MyOggy.com website immediately and cease using or visiting the domain or any derivative URL of MyOggy.com, or any service, applications, content, features, contests, or any other aspect provided at MyOggy.com. If you want to become a member of MyOggy.com, you must read this Agreement thoroughly, and indicate your acceptance and agreement during the member registration process. We may modify or make changes to this Agreement, which become effective upon posting, and your continued use, visits, or membership indicates acceptance of any modification or changes. Please check for changes so you can ensure you are up to date and are aware of any changes or modifications to this Agreement.
MyOggy.com is a social networking site, and Users must choose carefully the information, content, features, applications they choose to post, share, view, or participate in. Users are not permitted to upload, share, or post any inappropriate or impermissible or prohibited content , however should any Users violate this Agreement in any way, in whole or in part, Guardian Angel Enterprises LLC DBA MyOggy.com will not be responsible or held liable for any postings, information, or content, or misuse of MyOggy.com. If any User becomes aware of inappropriate content, impermissible content, or prohibited content please inform us by clicking on the Contact Us link, Report Abuse link, or Inappropriate Content links found throughout the website.
MyOggy.com reserves the right, in its sole discretion, to reject, refuse, or remove any posting (including private messages). MyOggy.com reserves the right to suspend, terminate, deny, or restrict all or part of any service, application, content, features, contests, or any other aspect provided by or at MyOggy.com, to any User at any time for any reason including but not limited to violation of this Agreement, as determined at it’s sole discretion, or for no reason at all without liability, without notice, and without explanation.
Eligibility: Use of MyOggy.com and membership at MyOggy.com is void where prohibited. By using MyOggy.com, you affirm that: a) all information provided by you is truthful and accurate; b) that you will maintain and update your personal information so as to maintain accuracy; c) that you are at least 14 years of age or older; d) your use of MyOggy.com does not and will not violate any law or regulation, or this Terms of Use Agreement. e) If you are at least 14 years of age, but under 18 years of age, your parent or legal guardian must read all terms and consent to your use or membership. f) To open a MyOggy.com business account, users must be at least 18 years of age or older. g) Participation in any contests requires that you be at least 18 years of age or older.

Fees or charges:MyOggy.com reserves the right to charge any fees related to our website, content, services, features, applications and modify or change those fees, if any. If your account is terminated or suspended, MyOggy.com is not liable or obligated to pay any refunds.
Passwords:MyOggy.com website offers password protected memberships, whereby the User registering can select a password during the registration process. It is the responsibility of all Users or Members to protect the confidentiality of their password, and MyOggy.com holds no liability or responsibility in managing a User’s password. You must notify us if you suspect unauthorized access to your account. Further a Member can change their password under “settings” and “Change password” when logged into their account.
Unsolicited contact, or commercial use: MyOggy.com provides it’s website, services, applications, features, and content for personal use to Members and Users and also provides Business Accounts to businesses, companies,or for promotional or commercial purposes for a monthly subscription. Users with promotional or commercial intent or advertising or commercial promotion of any kind, must select the Business and Networking Account level upon registering. MyOggy.com reserves the right to terminate, delete, suspend, remove or deny any account that violates any terms outlined in the terms of use agreement - in part or whole, if in MyOggy.com’s sole discretion, the member has violated any terms.
Business and Networking Account
MyOggy.com is currently offering both personal and business accounts free to members.
Member content/ postings: Members that upload, post, or display content such as words, text photos, images, music, videos, blogs, or any other Member posted content – Members retain any rights they already have to their content, with the exception of a limited shared license with MyOggy.com as described in this paragraph. By displaying or publishing, posting, uploading, or otherwise displaying any such content on or through the MyOggy.com website or services, you hereby grant to MyOggy.com a limited license to use, modify, change, delete from, add to, publicly display, reproduce, distribute such content solely on or through the MyOggy.com website. This limited license does not grant MyOggy.com permission to distribute such content outside the MyOggy.com website. The limited license you grant to MyOggy.com is non-exclusive so you are free to post or display the content anywhere else. Regarding any posting or display of content, including but not limited to photos, images, music, videos, blogs, text, authorship creations, artwork, or any other posting or content; You represent and warrant that (i) you have the legal right and authority to grant the rights set forth in our terms and rules and (ii) neither the Materials nor exercise of the rights granted to Guardian Angel Enterprises LLC DBA MyOggy.Com, under our Terms Agreement, including, without limitation, the public display, public performance, distribution, or reproduction of the Materials, or portions or derivative works thereof, will violate or infringe upon the copyright, literary, privacy, publicity, trademark, service mark or any other personal, contractual or property right of any person or entity anywhere in the world. MyOggy.com is not required to pay you for use of any such uploaded or displayed content on the MyOggy.com website.
Myoggy.com reserves the right to remove, deny, suspend or terminate any account including business accounts and personal accounts, or any account, if in it’s sole discretion, it has reason to believe the account, postings, content are in violation of these terms, the law, or a hindrance to the overall spirit and community of MyOggy.com. Further illegal and/or unauthorized use of the MyOggy.com services, features, content, applications, etc., including collecting usernames, user information, and/or email addresses or contact information of Members by electronic or other means for the purpose of sending unsolicited email, content, or unauthorized framing of or linking to the MyOggy.com website, or employing third party promotional sites or software to promote profiles for money, is prohibited. Links, advertisements, and/or any forms of unauthorized solicitation, music, text, photos, images, or any content may be removed from Member profiles without notice if deemed inappropriate by MyOggy.com admin. MyOggy.com reserves the right to take appropriate legal action for any illegal or unauthorized use of the MyOggy.com services, applications, features, content, website, etc.
Content provided by and on the MyOggy.com website is copyrighted and Users are not permitted to reproduce, sell, modify, distribute, publish, or broadcast any portion of it except for what is provided for in this Agreement.
MyOggy.com may refuse, deny, reject, remove, terminate, or suspend any account which has violated any portion of this Agreement, or posted any content which is illegal, pornographic, harmful in any way to other Users or the Myoggy.com website, inappropriate as decided at MyOggy.com’s sole discretion, or for any reason, without prior notice or explanation, and without liability. Content posted: MyOggy.com relies on Users’ notifications and reports, to be alerted to any impermissible content and does not monitor Users’ activities, postings, uploads, and displays. MyOggy.com assumes no responsibility or liability to content posted or displayed on the MyOggy.com website. Users are responsible and liable for all content they post or display on the MyOggy.com website. Certain areas of the website contain information, content, displays, or widgets which are streamed, provide by, or connected with other third party websites, and this content is not monitored or filtered or hosted by MyOggy.com. This content is still searchable, and viewable and may contain impermissible, inappropriate, or prohibited content. All use of the Myoggy.com website is AS IS AND AT YOUR OWN RISK. MyOggy.com does not prescreen content, pages, or profiles or otherwise confirm that the user is representing themselves or their business accurately.
Impermissible content or activity includes, but is not limited to the following:
Content that is racist, and/or promotes hate or bigotry or harassment
Solicits any information from a minor (someone under 18 years of age)
Sexually exploitive
Violence
Nudity
Pornography or links to adult or pornographic websites
Any posting or content which poses safety or security risk to any person, group, business, or the website
Any content or posting which violate or infringe upon the copyright, literary, privacy, publicity, trademark, service mark or any other personal, contractual or property right of any person or entity anywhere
Spamming or transmission of spamming or unsolicited emails or contact or promotion of; chain letters
Contains restricted or password protected pages or information
Any unlawful or illegal activity or the promotion thereof or instructional information about any illegal or unlawful activity
Misleading or deceptive content
Additional Prohibited Content: MyOggy.com reserves the right to take legal action against anyone who posts, displays, encourages, endorses, or promotes any illegal or unlawful activity. MyOggy.com reserves the right to report and fully disclose all personal information, postings, displays, uploads of such User to legal authorities. Such illegal or unlawful activity includes but is not limited to: drug use, drug dealing, trafficking, child pornography, obscene material, fraud, gambling, spamming, or sending, transmitting, creation, instruction, or promotion of computer viruses or malware, theft.
Additional Prohibited activity includes but is not limited spamming; unsolicited contact or emails; sending, transmitting, creation, instruction, or promotion of computer viruses or malware; theft; modifying or attempting to access and modify the database or any security features of the Myoggy.com website; covering, modifying, or otherwise hiding any advertisements on the Myoggy.com website; automated use of any part of the website or services; interfering or disruption of services or website; embedding MyOggy.com codes on to other websites such as to display MyOggy.com content; using another member’s account, password or information; disclosing your password; using MyOggy.com for any illegal or unlawful purpose; using a standard personal account to promote your business, website, commercial activities.
Members are responsible for their interactions with one another on or through the MyOggy.com website or services at MyOggy.com. MyOggy. Com reserves the right to become involved if deemed appropriate or necessary in it’s sole discretion.
MyOggy.com does not prescreen content, pages, or profiles or otherwise confirm that any user or member is representing themselves or their business accurately or that information is accurate or reliable, or that content, applications, videos or any other content is free from malware or viruses or other harmful components. Users and Members should exercise caution using the MyOggy.com website, including but not limited to: searching and viewing any content posted, downloading any content uploaded, interactions with other members, or any other activity on the MyOggy.com website.
MyOggy.com reserves the right to modify or change any part of the website or it’s features or services at any time, for any reason. MyOggy.com has no liability for protecting or storing any of your posted or uploaded content on the Myoggy.com website.
The use of the MyOggy.com website or services is also governed by MyOggy.com’s privacy policy.
You agree to be held responsible legally, in a court of law, and/ or monetarily to MyOggy.com, for any violation of this Agreement. The Agreement shall be governed by, and construed in accordance with, the laws of the State of Washington, without regard to its conflict of law provisions. You and MyOggy.com agree to submit to the exclusive jurisdiction of the courts located within the State of Washington to resolve any dispute arising out of the Agreement, the MyOggy.com privacy policy, or the MyOggy.com website and/ or services collectively. EACH OF THE PARTIES HEREBY KNOWINGLY, VOLUNTARILY AND INTENTIONALLY WAIVES ANY RIGHT IT MAY HAVE TO A TRIAL BY JURY IN RESPECT OF ANY AND ALL LITIGATION ARISING OUT OF, UNDER OR IN CONNECTION WITH THIS AGREEMENT. FURTHER, EACH PARTY HERETO CERTIFIES THAT NO REPRESENTATIVE OR AGENT OF EITHER PARTY HAS REPRESENTED, EXPRESSLY OR OTHERWISE, THAT SUCH PARTY WOULD NOT IN THE EVENT OF SUCH LITIGATION, SEEK TO ENFORCE THIS WAIVER OF RIGHT TO JURY TRIAL PROVISION. EACH OF THE PARTIES ACKNOWLEDGES THAT THIS SECTION IS A MATERIAL INDUCEMENT FOR THE OTHER PARTY ENTERING INTO THIS AGREEMENT.
You agree to release, and hold harmless Guardian Angel Enterprises LLC DBA MyOggy.com, subsidiaries, sponsors, affiliates, directors, officers, members, employees and agents from any and all liability, loss, damage, death, of any kind, related to participation or use of the MyOggy.com website, services, features, content, applications, contests, or the acceptance, possession or use of any prize awarded in any contest hosted by MyOggy.com. MyOggy.com further DISCLAIMS ANY AND ALL REPRESENTATIONS AND WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF TITLE, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT. All use of the Myoggy.com website is AS IS AND AT YOUR OWN RISK.
IN NO EVENT SHALL MYOGGY.COM BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL OR PUNITIVE DAMAGES, INCLUDING LOST PROFIT DAMAGES ARISING FROM YOUR USE OF THE MYOGGY.COM SERVICES, EVEN IF MYOGGY.COM HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. NOTWITHSTANDING ANYTHING TO THE CONTRARY CONTAINED HEREIN, MYOGGY.COM’S LIABILITY TO YOU FOR ANY CAUSE WHATSOEVER AND REGARDLESS OF THE FORM OF THE ACTION, WILL AT ALL TIMES BE LIMITED TO THE AMOUNT PAID, IF ANY, BY YOU TO MYOGGY.COM FOR THE MYOGGY.COM SERVICES DURING THE TERM OF MEMBERSHIP, BUT IN NO CASE WILL MYOGGY.COM’S LIABILITY TO YOU EXCEED $500.
Your use of the MyOggy.com website indicates you have fully read and agree to all the terms of this Agreement. The failure of MyOggy.com to exercise any right outlined in this Agreement does not constitute a waiver of any rights. If any provision(s) of this agreement is deemed invalid or unlawful, then that provision(s) is severable from this Agreement, and does not affect the validity of the Agreement, and the remainder of this Agreement remains in full affect.
